Post-HLR Supplemental Claim checklist for new and relevant evidence

Start with the HLR decision, not the old denial alone

A Higher-Level Review decision may discuss the same issue as the original denial, but it can also add reasoning about the existing record. Read the HLR decision before building a new evidence list.

Write down each issue, the evidence VA listed, and the reason the reviewer gave. The next step should answer that record, not a remembered version of the claim.

Look for evidence VA has not considered

VA says a Supplemental Claim is built around new and relevant evidence. New means VA has not considered it before; relevant means it tends to prove or disprove a matter at issue.

After HLR, that may mean a new medical opinion, private treatment record, lay statement, service record, DBQ, or another record tied to the reason VA gave.

Separate duty-to-assist correction from new evidence

If the HLR decision identifies a duty-to-assist error, VA handling may involve correction of an earlier development issue. Keep that separate from your own plan to submit new evidence.

If no duty-to-assist error is identified and the decision still points to a missing fact, a Supplemental Claim evidence map may be worth discussing with VA or an accredited representative.

Avoid resubmitting the same packet

A repeated packet is not the same as new and relevant evidence. Label each document by what it adds to the record and which finding it addresses.

The practical file map should answer three questions: what VA already reviewed, what is genuinely new, and why the new item matters to the issue.
